Article 2 – Applicability / Orders and Terms of Service
By placing orders on our website you accept that these terms and conditions are applicable immediately.
The entrepreneur will take the greatest possible care when receiving and executing orders for products and when assessing applications for the provision of services.
The place of delivery is the address that the consumer has made known to the company.
Article 3 – The offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The entrepreneur is entitled to change and adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. If the entrepreneur uses images, these are a true representation of the products and/or services offered. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
Article 4 – Prices
All prices include VAT. Additional costs such as delivery or other administrative costs will be separately stated/indicated during the check out process or on request by the consumer.
The entrepreneur can offer products or services whose prices are subject to fluctuations in the financial market and over which the entrepreneur has no influence, with variable prices. This dependence on fluctuations and the fact that any prices quoted are target prices are clearly stated in the offer.
All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typing errors. In the event of printing and typesetting errors, the entrepreneur is not obliged to deliver the product according to the incorrect price.
Article 5 – Payment
The buyer can handle his payments via the payment methods mentioned, namely Mollie.
As long as the payment has not been made, the goods remain the property of the entrepreneur.

Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will reply within the period of 14 days with a notification of receipt and an indication when the consumer will receive a more detailed
If a complaint is found to be well-founded by the entrepreneur, the entrepreneur will, at its discretion, replace or repair the delivered products free of charge.
Article 7 – Right of withdrawal
When delivering items:
When purchasing products, the consumer has the option to dissolve the agreement without stating reasons during 14 days. This reflection period starts on the day after receipt of the product by the consumer or a representative designated by the consumer in advance and made known to the entrepreneur.
The buyer must return the product to the seller within 14 calendar days in its original condition, unused, undamaged and in its original packaging:

The seller undertakes to refund the purchase price of the item(s) (excluding shipping costs) to the buyer within 30 days of receipt of the product.
In case of incorrect return in accordance with the above lists, the seller has the right to refuse a full refund of the item(s) and the item(s) remain the property of the seller. The consumer will be informed by e-mail (this is considered an official letter) and will have to pay shipping costs again.
Article 8 – Costs in case of withdrawal
If the consumer makes use of his right of withdrawal, the costs of return will be for his account at most.
If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal. This is subject to the condition that the product has already been received back by the entrepreneur or conclusive proof of complete return can be submitted.
The data of our customers is not passed on to third parties. Hart Voor Marthe may use this information for the promotion, promotions of the articles and services (newsletter, mails..etc).
Article 10 – Applicable law
Only Belgian law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply. Even if the consumer lives abroad.
The court in Mechelen has exclusive jurisdiction to hear all disputes that may arise between the consumer and the seller.
